These Terms of Use (“Terms”) govern your use of the Image Gallery app (“the App”) provided by Dialtone Apps (“we”, “us”). The App runs inside Microsoft Teams, including Teams desktop, Teams mobile, and Teams on the web (together, the “Teams client”). Image Gallery is not intended to be opened directly as a standalone website and actively prevents this. By using the App, you agree to these Terms.

1. Service Description

The App is a Microsoft Teams tab application that displays images shared in Teams chats and channels as a browsable, filterable gallery. It accesses images via the Microsoft Graph API using your existing Teams permissions.

The App is designed for browsing, filtering, viewing, and individually downloading images that you are already permitted to access in Teams. It is not a backup, archiving, eDiscovery, records-retention, or export tool for Teams chats, and it does not provide a bulk download or mass export feature for images.

2. Eligibility and Access

The App requires a Microsoft Teams-enabled Microsoft 365 work or school tenant and an active Image Gallery subscription for that tenant. A Microsoft 365 subscription alone may not include Microsoft Teams, and your organization is responsible for ensuring that Teams is licensed and available for the users who use the App. The Image Gallery subscription is separate from and in addition to any Microsoft 365 or Microsoft Teams licenses. Use of the App is subject to the number of Image Gallery seats purchased for your organization, and access may be restricted when the purchased seat allowance is exceeded. Your organization’s IT administrator is responsible for installing and managing the App within your tenant.

3. Acceptable Use

You agree not to:

Attempt to circumvent licensing or access controls
Reverse engineer, decompile, or disassemble the App
Use the App to violate any applicable laws or regulations
Interfere with or disrupt the App’s infrastructure

4. Intellectual Property and Customer Content

The App and its source code are the property of Dialtone Apps. Images displayed in the App belong to their respective creators and are accessed through Microsoft Teams. We do not and technically cannot claim ownership of your content because we never receive or store your images, message content, or image metadata.

The App processes Teams messages, images, and related metadata inside the Teams client. Because that content is not sent to or stored by us, we cannot know, review, moderate, verify what content your organization has in Teams, or take responsibility for your content in Teams.

5. Subscription and Billing

Subscription terms and pricing are communicated at the time of purchase. Subscriptions renew automatically unless cancelled. You may cancel at any time; access continues until the end of the current billing period.

6. Disclaimer of Warranties

The App is provided “as is” without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free operation. The App depends on Microsoft Teams and Microsoft Graph API availability, which are outside our control.

7. Limitation of Liability

To the maximum extent permitted by law, Dialtone Apps shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including loss of data, loss of profits, business interruption, or loss of goodwill.

Our aggregate liability for direct damages relating to the App shall not exceed the fees actually paid to us for the App for the affected tenant during the 12 months before the event giving rise to the claim. This limitation does not create an automatic refund right and does not limit liability that cannot be limited by law.

8. Image Processing Features Disclaimer

The App includes optional image processing features for image classification and text recognition. These features are provided for convenience and may produce inaccurate results. Image processing runs inside the Teams client on the user’s device. No image data is sent to external services for processing.

9. Termination

We may suspend or terminate your access if you violate these Terms. You may stop using the App at any time by uninstalling it from your Teams environment and cancelling your subscription through the applicable billing channel. Uninstalling the App alone may not cancel subscription billing.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of Switzerland, excluding conflict-of-law rules. Any disputes shall be subject to the exclusive jurisdiction of the competent courts at the domicile of Dialtone Apps in the Canton of Zurich, Switzerland, unless mandatory law provides otherwise.
